Post-Publication Discussion Policy
LEGAL BRIEF supports scholarly discussion and constructive academic debate after the publication of an article. Post-publication discussion provides an opportunity for readers, researchers, and other interested parties to comment on published work, clarify interpretations, identify potential errors, and contribute to the development of legal scholarship.
The journal is committed to ensuring that post-publication discussions are conducted fairly, professionally, transparently, and in accordance with recognized publication ethics principles, including the applicable guidelines of the Committee on Publication Ethics (COPE).
1. Scope of Post-Publication Discussion
Post-publication discussion may address articles published in LEGAL BRIEF, including their legal arguments, theoretical foundations, research methods, interpretation of legal provisions, analysis of court decisions, findings, conclusions, and contributions to legal scholarship.
Submissions may include scholarly comments, critical responses, methodological observations, alternative interpretations, or evidence-based concerns regarding the accuracy, originality, validity, or ethical integrity of a published article.
All contributions must be relevant to the original publication and provide a clear academic or scientific basis for the discussion.
2. Submission Requirements
Readers and researchers who wish to submit a post-publication comment should submit their manuscript to the editorial office of LEGAL BRIEF through the journal's official submission system or the communication channel designated by the journal.
A submission should include:
-
The title and complete bibliographic details of the article being discussed, including its DOI where available.
-
The name, institutional affiliation, and contact information of the contributor.
-
A clear explanation of the purpose and principal argument of the comment.
-
Relevant supporting evidence, legal authorities, references, or methodological explanations.
-
A declaration of any competing interests relevant to the discussion.
Submissions must be original, relevant, academically rigorous, and written in a respectful and professional manner. Personal attacks, defamatory statements, unsupported allegations, discriminatory language, and comments unrelated to scholarly discussion will not be considered.
3. Editorial Assessment and Review
All post-publication discussion submissions are subject to an initial assessment by the Editor-in-Chief or a designated editor to determine their relevance, academic merit, clarity, and compliance with the journal's publication ethics standards.
The editor may accept the submission, request revisions, reject it, or send it for independent peer review when specialist assessment is necessary.
Independent review may be requested for submissions involving substantial legal disagreements, technical methodological criticism, allegations of research misconduct, or issues requiring specialized expertise.
Editorial decisions will be based on the scholarly quality and relevance of the submission rather than the author's institutional affiliation, academic position, or viewpoint.
4. Right of Reply
When a post-publication comment raises substantive criticism of a published article, the original author or authors will normally be given an opportunity to respond.
The response should address the issues raised directly, provide relevant evidence or clarification, and maintain an appropriate academic tone.
The editorial team may publish the comment and the corresponding author response together or separately, depending on the circumstances and editorial considerations. Both contributions will be subject to editorial assessment and, where necessary, peer review.
The journal will seek to ensure that significant scholarly disagreements are presented fairly and that the parties have a reasonable opportunity to explain their positions.
5. Publication and Linking
Accepted post-publication discussions and author responses may be published as separate scholarly contributions in LEGAL BRIEF.
Where appropriate, the published comment will be electronically linked to the original article, and the original article will include a link to the related discussion or response.
Published contributions will include appropriate bibliographic information and a DOI where assigned. They will be made accessible in accordance with the journal's applicable publication and access policies.
Publication of a comment or response does not automatically alter the status, findings, or conclusions of the original article.
6. Allegations of Errors or Research Misconduct
If a post-publication discussion identifies credible concerns regarding factual errors, legal misinterpretations, methodological deficiencies, plagiarism, data manipulation, authorship disputes, or other potential publication ethics violations, the Editor-in-Chief will assess the matter separately from the decision to publish the discussion.
The journal may request supporting evidence, contact the authors, consult independent experts, or refer the matter to the relevant institution or authority where appropriate.
Depending on the evidence and seriousness of the concern, the journal may issue a correction, an Expression of Concern, a retraction, or another appropriate editorial notice in accordance with its Corrections, Retractions & Expressions of Concern Policy.
The journal will not treat an allegation as established misconduct solely because it has been raised in a comment or discussion.
7. Ethical Standards and Confidentiality
All participants in post-publication discussions are expected to comply with applicable publication ethics standards, respect intellectual property rights, disclose relevant competing interests, and avoid misleading or unsupported claims.
The editorial team will handle submissions and related communications confidentially to the extent reasonably possible, while maintaining the transparency necessary for a fair editorial assessment.
The journal reserves the right to reject or decline to publish contributions that fail to meet its academic, ethical, or editorial requirements.
8. Editorial Independence and Final Decisions
The Editor-in-Chief retains responsibility for editorial decisions concerning post-publication discussions and responses. Decisions will be made impartially, based on scholarly merit, relevance, supporting evidence, and compliance with the journal's policies.
LEGAL BRIEF encourages constructive scholarly criticism and recognizes post-publication discussion as an important mechanism for improving the quality, accountability, and reliability of legal research.
