Digital Communication Transformation in Legal and Socio-Legal Perspec-tives: The Urgency of Digital Literacy

Abstract

he rapid transformation of digital technology has reshaped patterns of human communication, shifting many interpersonal interactions from face-to-face settings to instant messaging, electronic mail, and other digital platforms. Although digital communication enables users to formulate, review, store, and document messages more efficiently, existing discussions have often focused primarily on technological convenience and changes in communication behavior, while giving comparatively limited attention to the intersection between legal protection, communication ethics, and digital literacy. This study addresses this gap by examining digital communication as both a legal and socio-legal environment and by identifying the regulatory and literacy requirements necessary for responsible digital interaction. The study employs a normative juridical method using statutory and conceptual approaches. Its primary legal sources are Indonesia’s Law on Electronic Information and Transactions and Law No. 27 of 2022 on Personal Data Protection, supported by relevant legal concepts concerning electronic communication, privacy, legal responsibility, and digital conduct. The findings demonstrate that the transition to text-based digital communication creates legal implications that extend beyond changes in communication media. The absence of facial expressions, tone, body language, and immediate contextual clarification may increase the risk of textual ambiguity, misinterpretation, evidentiary disputes, privacy violations, unauthorized dissemination of electronic information, and misuse of personal data. The study further finds that legal regulation alone is insufficient to address these risks. Digital literacy functions as an essential socio-legal mechanism by enabling individuals to understand the legal consequences of electronic communication, protect personal and third-party data, critically interpret digital messages, maintain communication ethics, and exercise greater responsibility before creating, transmitting, or disseminating digital content. The novelty of this study lies in integrating normative legal analysis with a socio-legal understanding of digital literacy, thereby positioning digital literacy not merely as a technical competence but as an instrument of preventive legal awareness and responsible digital citizenship. Practically, the study contributes to the development of an ethical, secure, and responsible digital communication framework based on legal awareness, privacy protection, careful interpretation of electronic messages, and accountability in digital interactions. Accordingly, an effective future communication model should not simply privilege digital communication over face-to-face interaction, but should combine technological efficiency with legal compliance, ethical responsibility, digital literacy, and the contextual strengths of interpersonal communication
